MEMORANDUM OPINION AND ORDER

RICHARD L. SPEER, Bankruptcy Judge.

This cause comes before the Court on Debtor’s Motion to Remove D. Bowen Loef-fler as Trustee in this matter for failure to prosecute a preference. A Hearing was held at which time the parties were to brief the issues raised in the Debtor’s Motion. Prior to the due date for the briefs, the Trustee filed a Motion to Dismiss the Debt- or’s Motion to Remove D. Bowen Loeffler as Trustee.
