It appears from the petition of plaintiff, that at an election in and for the county of Lafayette, held on the 6th day of November, 1866, he received a majority of all the legal votes cast at said election for the office of sheriff of said county ; that he received a certificate of his election, and on the third day of January next thereafter the Governor of the State issued and delivered to him a commission as sheriff in conformity with the requirements of law ; that previous to the election he took and subscribed the oath of loyalty, and, after the receipt of his commission, the required…
