This litigation originated as an action on the case brought in the superior court of Cook county by the appellant, the Foreman-State National Bank, against Charles A. Sistek and eleven others, to recover damages alleged to have been sustained by reason of the making of certain representations to the bank, claimed to have been false, in connection with the procuring of a loan by the Elston Securities Corporation, of which the defendants were directors and Sistek president.
