JACKSON, Chief Justice.

This suit was instituted in the District Court of Montague County by the appellant, C. W. Coffield, against the appellees, E. R. Cox and wife, A. B. Cox, to enforce specific performance of a written contract for the conveyance by appellees to appellant of an undivided one-half interest in the mineral rights to a certain 80 acre tract of land in Montague County fully described in the petition.

On separate pleas of privilege filed by the defendants the case was transferred to Kent County where it was tried on its merits.
