HODGES, J:

This appeal is from a judgment rendered in the court below in favor of the appellee against the appellant for damages for breach of a contract.

Omitting formal parts, the petition is, in substance, as follows: It is alleged: That on March 10, 1908, the plaintiff, Allen, entered into a contract with the defendant by which it agreed to furnish him a telephone instrument in his residence at Springdale, Tex., “and telephone service to and at Queen City, for a consideration of fifty cents .per' month,” the plaintiff and a number of other subscribers having agreed to erect a private line…
