Affirming.

William Klein, whose will is before ns for construction in this action, was born in Germany in the year 1839. There lie learned the trade of a baker. He camo to the United States when he was 18 years of age, and located in Louisville, Ky. In 1863 he married Elizabeth Klink, and in 1864 there was born to him a son, John W. Klein. In 1869 there was born to Mm a daughter, Mamie Klein, who' intermarried with appellant, Charles F. Busehemeyer, in the year 1890. She died in the year 1908, without children. John W.
