This is an action for a settlement and partition of the estate, in community, between the defendant and his deceased wife, who it is alleged was the plaintiff’s sister. The petitioner represents that the defendant’s wife, his sister, died on the 22d of July, 1841, leaving no heirs in the descending or ascending lines, and no other brother and sister besides himself, and that he is consequently her sole heir and representative ; that his sister intermarried with the defendant on or about the 13th of January, 1823 ; that on her decease, she left a large estate consisting as well of separate…
