HOLMES, Judge.

This is an appeal from a decree of the Colbert County Circuit Court, in Equity, rendered on September 12, 1972. The case was submitted to this court on April 4, 1973.

In 1967, the Circuit Court of Colbert County entered a decree divorcing the appellee from appellant and an agreement between the parties was incorporated in the court decree and made a part thereof. By the terms of the agreement the appelleehusband was awarded custody of the two minor children of the parties who are approximately nine and eight years of age.
