Proceeding pursuant to CPLR article 78 (transferred to this Court by order of the Supreme Court, entered in Albany County) to review a determination of the Commissioner of Correctional Services which found petitioner guilty of violating certain prison disciplinary rules.
Petitioner, a prison inmate, was served with a misbehavior report charging him with various disciplinary infractions after an incident in which he allegedly stood up in a crowded mess hall, threw his food tray in the air and engaged in an obscenity-laced tirade directed at another inmate.
