This is a suit under the Workmen’s Compensation Act (Act 20 of 1914 and amendments).
Homer Flowers was employed by defendant to work about a sawmill. On the day he was injured he was told by the proprietor of the mill to assist a truck driver in transporting lumber. After delivering a load of lumber he and the driver got on the truck to return to the mill and while on their way the driver gave him a chew of tobacco which made him sick or rendered him unconscious so that he fell from the truck to the paved road and sustained the injury of which he complains.
