This is án action of trespass brought by the Ameri can Seating Company to recover the value of 426 theatre chairs alleged by plaintiff' to have been converted by defendants.

It appears that on January 14, 1930, the defendants leased the theatre premises, owned by them in New Castle, to one Max Cransfield for a period of eight years, commencing January 1, 1930, at a total rental for the entire term of $61,800, payable in monthly instalments, in advance, of $450 during the first year of the term, and at a graduating increased monthly rental thereafter.
