Plaintiff, an assured, and defendant, an insurance company, have agreed to submit to this court for determination a controversy existing between them as to coverage under a policy of public liability insurance. The policy was issued on January 17, 1931, by the defendant company to the plaintiff, the owner of a theatre at Floral Park, N. Y.
