In Error to the District Court of the United States for the Southern District of New York. Leopold Harris was convicted of aiding and abetting another in violating the Harrison Narcotic Drug Act, and he brings error.

ROGERS, Circuit Judge.

The indictment charged one Joseph Freilich, a druggist, with violating Harrison Narcotic Drug Act Dec. 17, 1914 (38 St. at Large, p. 785 [Comp. St. §§ 6287g-6287q]). It also charged the plaintiff in error, hereinafter called the defendant, with aiding and abetting Freilich therein. The indictment was filed on June 24, 1919, and as presented it contained seven counts, six charging substantive offenses and one charging conspiracy.
