Appellant, as the executrix of the estate of Joe P. Williams, deceased, filed this ..suit in the district court of Ellis county, in form of trespass to try title, against the appellee for the possession of 94 acres of land, which is fully described in the petition. A writ o£ sequestration was also sued out and appellee having failed to replevy, he was ejected from the premises.
