This matter is before the court on condemnee’s preliminary objections to condemnor’s declaration of taking. Condemnee is Budco Theatres Inc., the successor by merger to .York Drive-Ins Inc. Condemnor is Springettsbury Township. We dismiss the preliminary objections.
