Dorothy B. Bach sued First Union National Bank (“FUNB”), alleging (1) a violation of the Fair Credit Reporting Act (“FCRA”), 15 U.S.C. § 1681s-2(b); (2) negligence; (3) intentional infliction of emotional distress; (4) defamation; (5) invasion of privacy; and (6) a violation of the Fair Credit Billing Act, 15 U.S.C. § 1666(a). At the close of plaintiffs case, the district court granted FUNB’s motion pursuant to Federal Rule of Civil Procedure 50(a) for a judgment as a matter of law on all claims except the FCRA claim.
