Plaintiffs in error, Dewey Talbe and Clem Teddric, were jointly indicted in the circuit court of Madison county with one Norman Crane, charged with an assault with intent to rape. Plaintiffs in error moved to quash the indictment, and upon their motion being overruled pleaded not guilty. Upon a trial the jury found them guilty as charged in the indictment and found their ages to be twenty-four and twenty-three, years, respectively. They were sentenced to the penitentiary for an indeterminate term of not less than one year nor more than fourteen years. They have prosecuted this writ of error…
