*647In an action, inter alia, to recover damages for fraud, the plaintiff appeals from so much of an order of the Supreme Court, Kings County (D. Schmidt, J.), dated September 27, 2006, as granted that branch of the motion of the defendants Sanders, Gutman & Brodie, EC., and Jordan Brodie which was to dismiss the complaint insofar as asserted against them pursuant to CPLR 3211 (a) (1).
Ordered that the order is affirmed insofar as appealed from, with costs.
