*853In an action for a judgment declaring that the defendants are obligated to defend and indemnify the plaintiff in an underlying action entitled City of New York v Outlook Realty, LLC, pending in the Supreme Court, New York County, under index No. 400100/05, the plaintiff appeals from an order of the Supreme Court, Queens County (Cullen, J.), dated September 3, 2008, which granted those branches of the defendants’ motion which were pursuant to CPLR 3211 (a) (1) and to declare that they were not obligated to defend or indemnify the plaintiff in the underlying action.
