NICHOLLS, J.
In the petition of the plaintiff to the district court she alleged: That she was the beneficiary of a certain life insurance policy issued upon the life of Pierre J. Pavy by the Franklin Life Insurance Company of Illinois. The said policy of life insurance is numbered 35,053, is for the sum of $2,000, and, being now in the possession of petitioner as beneficiary thereof, is hereto annexed for reference only and specially referred to.
