PETITION FOR WRIT OF MANDAMUS
BOWEN, Presiding Judge.
This is a petition for writ of mandamus challenging the constitutionality of the capital offense defined in Ala.Code 1975, § 13A-5-40(a)(15), which we term “child murder.”
The petitioner, 37-year-old Susan Amelia Woodard was indicted for the capital murder of 15-month-old Elizabeth B. Dowe Franklin. The events that form the basis of the State’s case occurred on December 29, 1992, and January 6, 1993.
