Before this Court is an appeal of the January 11, 2001 decision of the Charlestown Zoning Board, sitting as the Platting Board of Review (Board), which reversed the September 20, 2000 decision of the Charlestown Planning Commission (Commission). The Commission's decision denied J. F. Smith Builders, Inc's (Smith) application for preliminary subdivision approval for a parcel of land designated as Assessor's lot 204-5 (Oak Hollow) within the Town of Charlestown, Rhode Island.
