[■This is an appeal from a judgment for plaintiffs in an action Hr damages by purchasers of land against sellers and their M,1 estate agent. The action was originally tried in the *88eleventh judicial district, county of Lincoln and resulted in a directed verdict for defendants. Plaintiffs appealed, the judgment was vacated, and the cause remanded for retrial. Goggans v. Winkley, 154 Mont. 451, 452, 459, 465 P.2d 326 (hereinafter referred to as the first case).
