Appeal by the defendant from a judgment of the Supreme Court, Suffolk County (Hinrichs, J.), rendered January 20, 2011, convicting him of criminal sale of a controlled substance in the second degree, upon his plea of guilty (Asher, J.), and imposing sentence, including restitution in the sum of $4,980.

Ordered that the judgment is modified, on the law, by vacating the restitution in the sum of $4,980; as so modified, the judgment is affirmed, and the matter is remitted to the Supreme Court, Suffolk County, for a hearing and new determination concerning the proper amount of restitution and the…
