Woodward, J.:
On the 20th day of April, 1899, J. Albert Mahlstedt died, leaving a last will and testament, which was duly admitted to probate, dis*177posing of all of his property to his wife, Margaret L. Mahlstedt. His last illness began in February, 1899. At the time of his illness, and for some years prior thereto, he had been the president of a corporation, known as the J. A. Mahlstedt Lumber and Coal Company, and on the 29th day of March, 1899, was the owner of 560 of the 750 shares of stock of the said corporation.
