Appellant brought this action in the circuit court of Perry county against appellees, W. D. Mills, justice of the peace, and the United States Fidelity & Guaranty Company, surety on his official bond, for a breach of the condition of the bond. Appellee demurred to the declaration, which demurrer was, by the court, sustained, and judgment entered dismissing the suit, from which an appeal was prosecuted to this court. The judgment of the lower court was reversed, this court holding that the declaration stated a good cause of action. Hodges v. Mills et al., 139 Miss. 347, 104 So. 165.…
