In a proceeding pursuant to CPLR article 78 to review a determination of the New York City Water Board dated April 24, 2006, which confirmed a determination of the New York City Department of Environmental Protection dated June 6, 2005, upwardly adjusting charges for water and sewer services rendered between February 3, 2000 and February 3, 2004, the petitioner appeals from so much of an order and judgment (one paper) of the Supreme Court, Queens County (Elliot, J.), entered January 8, 2008, as denied the petition and dismissed the proceeding.
