MILLER, Associate Justice.
In 1915 appellant, a lawyer, and appellee, an inventor, entered into a contract concerning an aerial torpedo bomb “and patents or any improvements or additions * * * to said bomb or patents as well as * * * moneys * * * received from the sale of said bomb or as royalty” therefor. Subsequently appellee abandoned his original application for a patent and denied that any effective contract still existed between himself and appellant.
