This matter is in this court on appeal from a judgment of the Probate Court of Montgomery County upon the petition for declaratory judgment.

The petition below recites that the Winters National Bank & Trust Company is trustee under the will of Ray K. Barlow, deceased, being appointed by the Probate Court of Montgomery County; that under the last will and testament of Ray K.
