On the 1st day of August, 1883, William H. Estes, aged twenty years, at his solicitation was employed by S. W. Parr, foreman of the round-house of the shops of the Union Pacific Railway Company at Armstrong, Wyandotte county, to work for the company. Before this time, Estes had worked for a short time for the company in the boiler shops. Before his employment by the plaintiff in error he had worked for about three months in the yards of the Chicago & Alton Railroad Company as a helper to a hostler.
