REASONS FOR JUDGMENT
Three defendants who are to be sentenced this date have moved to set aside the sentencing guidelines promulgated by the United States Sentencing Commission pursuant to 28 U.S.C. § 994(a) on the alternative grounds that the statute creating the Commission is unconstitutional and that the Commission violated its statutory mandate. After considering the memoranda of the parties and the Sentencing Commission as amicus curiae, we conclude that the statute is constitutional and that the guidelines were lawfully adopted.
