This is a motion made by the defendant for final judgment on a demurrer. The action was predicated on fraud, and the plaintiff’s complaint alleged false representations made by the defendant as to its financial condition. Defendant demurred to the complaint on the ground that it failed to state facts sufficient to constitute a cause of action. The demurrer was sustained by one of the justices of this court. Plaintiff appealed to the Appellate Term of the Supreme Court from the interlocutory judgment entered on that decision. The Appellate Term affirmed said judgment and sustained the…
