In an action to recover on a promissory note, plaintiffs appeal, as limited by their brief, from so much of an order of the Supreme Court, Nassau County (Murphy, J.), dated August 20,1982, as denied those branches of their motion which sought summary judgment and dismissal of defendant’s counterclaims. *564Order reversed insofar as appealed from, on the law, without costs or disbursements, and those branches of plaintiffs’ motion which sought summary judgment and dismissal of defendant’s counterclaims are granted.
