In a claim to recover damages for personal injuries, etc., the plaintiffs appeal from an order of the Court of Claims (Lack, J.), dated March 28, 2005, which granted that branch of the defendant’s motion which was for summary judgment dismissing the claim.

Ordered that the order is modified, on the law, by deleting the provision thereof granting that branch of the defendant’s motion which was for summary judgment dismissing the plaintiffs’ Labor Law § 200 claim and substituting therefor a provision denying that branch of the motion; as so modified, the order is affirmed, without costs or…
