COE, Chief Justice.

This action was brought by The First Methodist Church of Nacogdoches, Texas, against J. Farris Jinkins and Mrs. John D. Ruple as against the appellee J. Farris Jinkins. The action was for specific performance of a certain contract to remove certain improvements from property deeded by him to The First Methodist Church ■as well as for damages. As against the ap-pellee Mrls. John D. Ruple, appellant sought a decree denying she had any claim, title or right to the -premises and ousting her from the possession thereof.
