RE, Chief Judge:

Appellant, James McHugh, appeals from a judgment of conviction entered against him on March 27, 1984, following a jury-trial in the United States District Court for the District of Rhode Island. Appellant was convicted of possession of marijuana with intent to distribute, in violation of section 2 of Title 18, United States Code and section 401 of the Comprehensive Drug Abuse Prevention and Control Act of 1970, 21 U.S.C. § 841 (1982).
