MEMORANDUM OPINION AND ORDER

BARBOUR, Chief Judge.

This cause is before the Court on the Motion of defendant Illinois Central Railroad Company (“ICRR”) for Summary *424Judgment pursuant to rule 56 of the Federal Rules of Civil Procedure. The Plaintiff Madison County Board of Education (“Madison County”) has responded to the Motion, and the Court, having considered the motion and response together with memo-randa of authorities and attachments thereto, is of the opinion that there exist no genuine issues of material fact, and that the Defendant ICRR is entitled to judgment as a matter of law.
