COFFEY, Circuit Judge.

On March 27, 1998, a Menominee Tribal police officer discovered the body of Mary Tomow, a Menominee Indian, along Spirt Rock Road on the Menominee Indian Reservation located in Wisconsin. After an investigation, the defendant was charged in a one-count indictment with the murder of Mary Tomow. On September 19, 2000, Christopher Matchopatow pleaded guilty to one count of second degree murder, 18 U.S.C. § 1111(a). 1 Pursuant to the plea agreement, Matchopatow waived, among other things, the right to challenge his conviction or sentence in any appeal or post-conviction…
