At a bench trial defendant was convicted of theft of an automobile under Section 16-1 of the 1961 Criminal Code. Ill Rev Stats 1963 c 38, § 16-1. He was sentenced to the penitentiary for a term of two to five years. Defendant contends on this appeal that the evidence was insufficient to support a conviction under Count I (§ 16-l(a)(l)) and that Count II (§ 16-l(d) (3)) does not charge a crime and is therefore insufficient at law.
