This was another railroad-crossing accident case. Plaintiff was a rural mail carrier, who made his daily rounds in a Ford automobile. On his route was a public road which ran east and west about three miles northeast of Osawatomie. The main line of the Missouri-Kansas-Texas Railroad Company, which runs north and south thereabout, crosses the public road at right angles. In July, 1937, the defendant had permitted weeds to grow to a height of six or seven feet, to within six feet from the rails. These weeds also narrowed the traveled…
