*649In an action to recover damages for personal injuries, etc, the defendants Gina M. Biaseti, as temporary administrator for the estate of Kathleen M. Poltrack, and Frisco Farm, Inc, appeal, as limited by their brief, from so much of an order of the Supreme Court, Dutchess County (Dillon, J.), dated April 28, 2003, as denied their motion for summary judgment dismissing the complaint insofar as asserted against them.

Ordered that the order is affirmed insofar as appealed from, with costs.
