On September 20, 1996, plaintiff Peggy Kelley filed a civil rights complaint under Title 42 U.S.C. § 1983 against Marion County Deputy Sheriffs Mark Myler and Gene Patrick, Ralph Bell, a private citizen allegedly acting in concert with the officers, and Hurricane Foods, Inc., Bell’s employer.. She alleged that her civil rights were violated when she was arrested and prosecuted for trespass while exercising her First Amendment right to free speech.
