This appeal is from a judgment on a directed verdict given in favor of the Chesapeake & Ohio Railway Company'at the conclusion of the evidence offered for the appellant. ' It is conténded that the case should have gone to' the jury, because no one has the right to wantonly or needlessly, kill a human being although he may be careless or a trespasser on forbidden premises.
