Gracy Howard died intestate, leaving certain heirs at law. In 1918 one of the heirs, alleging that he had purchased the interest of another heir, and acting in his own behalf and as next friend for the minor children of another heir since deceased, instituted a proceeding against the remaining heirs and heirs of deceased heirs, for partition of a tract of land irregular in shape, containing 118 acres, more or less, alleged to have been left by the intestate.
