The defendant, Thomas Hogan, appeals the judgment entered by the Circuit Court of the City of St. Louis, following his conviction by a jury of two counts of engaging in unlawful merchandising practices, a class D felony in violation of section 407.020 RSMo. (2000). 1 The trial court sentenced Hogan to four years’ imprisonment on each charge, to be served concurrently, but suspended execution of the sentence and placed him on probation for five years.
