MEMORANDUM AND ORDER

LUNGSTRUM, District Judge.

This duty to defend and indemnify action arises out of an insurance coverage dispute over faulty workmanship on a construction project in LaCygne, Kansas. Plaintiff Fidelity & Deposit Company of Maryland (“F & D”) claimed that defendant Hartford Casualty Insurance Company (“Hartford”) breached its duties to defend and indemnify its insured parties, National Contractors, Inc.
