These two cases involve the same defendant and are considered together because of their similarity.

The defendant was separately tried under two indictments of unlawfully distributing marijuana in violation of the Georgia Controlled Substances Act. Motions for discovery were made and denied, and motions to quash were likewise made and denied. In case No. 51934 (no. 28553), defendant was convicted and sentenced to serve five years.
