Defendant appeals the overruling of his plea of former jeopardy. Defendant’s previous convictions for incest and cruelty to a child were reversed by this court in Glisson v. State, 188 Ga. App. 152 (372 SE2d 462) (1988).
The sole issue on this appeal is whether the State’s attempt to retry defendant for cruelty to a child violates the proscription against double jeopardy contained in the Fifth Amendment to the United States Constitution and the statutory prohibition contained in OCGA § 16-1-8 (d) (2).
