The action was brought to recover damages for refusal of the defendant to perform a contract *838alleged to have been made by him with the plaintiff to sell and deliver to the latter seventy sheep. It appears that on January 12, 1884, an agreement was made between the parties for the sale by the defendant of the sheep to the plaintiff, to be delivered a month thereafter at five and a half cents per pound.
