In the night of August 26, 1876, William England, his wife, and two of her children were assassinated at their home in the county of Montague. In the ensuing October the grand jury presented a number of indictments against A. K. Taylor, James Preston, and Krebs, the appellant.

On the thirty-first day of October, 1876, the grand jury of Montague County returned into court a bill of indictment chargingthis appellant and one James Preston with the murder of Selena England on the previous twenty-sixth day of August.
